Le Cabinet vient d\u2019obtenir une d\u00e9cision favorable en ce sens. Nous avons obtenu la condamnation d\u2019un promoteur \u00e0 indemniser l\u2019acheteur malgr\u00e9 l\u2019annulation du permis de construire initiale.<\/span><\/p>\n<h2><span style=\"text-decoration: underline; color: #282828;\"><strong>I Les faits<\/strong><\/span><\/h2>\n<p style=\"text-align: justify;\" data-sourcepos=\"5:1-5:299\"><span style=\"color: #282828;\">Un particulier a achet\u00e9 un appartement en VEFA aupr\u00e8s d\u2019un promoteur. L\u2019acte de vente pr\u00e9voyait une livraison du bien au plus tard au premier trimestre 2020. Malheureusement, le bien sera livr\u00e9 plus d\u2019un apr\u00e8s la date limite pr\u00e9vue.<\/span><\/p>\n<p style=\"text-align: justify;\" data-sourcepos=\"5:1-5:299\"><span style=\"color: #282828;\">Nous avons alors saisi le Tribunal judiciaire afin d\u2019obtenir la condamnation du promoteur \u00e0 rembourser les int\u00e9r\u00eats intercalaires, les frais d\u2019assurances du pr\u00eat ainsi que le remboursement des loyers pay\u00e9s durant les travaux pour stocker les affaires.<\/span><\/p>\n<h2><span style=\"text-decoration: underline; color: #282828;\"><strong>II L\u2019annulation \u00a0du permis de construire est elle une cause l\u00e9gitime de retard\u00a0?<\/strong><\/span><\/h2>\n<p style=\"text-align: justify;\" data-sourcepos=\"5:1-5:299\"><span style=\"color: #282828;\">L\u2019acte de vente pr\u00e9voyait une clause stipulant que le promoteur pouvait \u00eatre exon\u00e9r\u00e9e de son obligation de livrer le bien en VEFA dans les d\u00e9lais contractuellement pr\u00e9vus en cas de survenance d\u2019une cause l\u00e9gitimes et s\u00e9rieuses.<\/span><\/p>\n<p style=\"text-align: justify;\" data-sourcepos=\"5:1-5:299\"><span style=\"color: #282828;\">L\u2019acte de vente \u00e9num\u00e9rait les causes l\u00e9gitimes de retard. Celles-ci parmi lesquelles \u00ab les injonctions administratives et judiciaire de suspendre ou arr\u00eater les travaux \u00bb. Nous estimions que l\u2019annulation du permis de construire \u00e9tait imputable \u00e0 la soci\u00e9t\u00e9.\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\" data-sourcepos=\"5:1-5:299\"><span style=\"color: #282828;\">Le Tribunal a accueilli cette argumentation en consid\u00e9rant notamment que le promoteur avait perdu l\u2019une des proc\u00e9dures en omettant de notifier des conclusions dans les d\u00e9lais, en se gardant bien de transmettre des \u00e9l\u00e9ments permettant d\u2019expliquer en quoi elle ne serait pas responsable de l\u2019annulation du permis et en s\u2019abstenant d\u2019informer l\u2019acqu\u00e9reur de la proc\u00e9dure en cours au moment de la signature de l\u2019acte de vente.<\/span><\/p>\n<p style=\"text-align: justify;\" data-sourcepos=\"5:1-5:299\"><span style=\"color: #282828;\">C\u2019est dans ces conditions que la d\u00e9cision a \u00e9t\u00e9 favorable.
